Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "Regulation") in accordance with Section 19 of Act No. 18/2018 Coll. on the Protection of Personal Data (hereinafter referred to as the "Act").

Dear Customers,

This document is to inform you of your rights and other important information about the processing of your personal data. The protection of your personal data is important to us, so we take a responsible approach to data protection and strive to ensure your right to information alongside it. When processing your personal data, we also adhere to the principles of lawfulness, purpose limitation of personal data, minimisation of scope and storage, accuracy, integrity, confidentiality and accountability.

II. PURPOSE OF PROCESSING

We process your personal data for the following purposes:

a) the performance of contractual obligations - the conclusion of a contract, e.g. a contract of sale and related obligations and rights under the contract of sale (delivery of goods, exercise of consumer rights, etc.) between you and us, the processing of your order and the exercise of rights and obligations arising from the contractual relationship between you as the buyer and our company as the seller. When placing an order, the data required for the successful processing of the order and delivery of the goods are requested. The provision of personal data is a necessary requirement for the conclusion and performance of the purchase contract, without the provision of personal data it is not possible to conclude the contract or to perform it on the part of the Operator.

b) direct marketing - sending emails with our marketing offers or news - you can object to the use of your personal data for direct marketing at any time, which will result in us ceasing to use your personal data for direct marketing purposes without delay

III. PERSONAL DATA PROCESSED

We process your following data: name and surname, place of residence, place of delivery, e-mail, telephone contact.

IV. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

We process your personal data on the following legal basis:

legal basis for the performance of the purchase contract: according to the provisions of § 13 (1) (b) of Act No. 18/2018 Coll. on the protection of personal data - performance of the contract between you as the buyer and our company as the seller

legal basis for direct marketing: legitimate interest: according to the provisions of §13 (1) (f) of Act No. 18/2018 Coll. on the protection of personal data - is based on the legitimate interest of our company in providing direct marketing

V. AFFECTED PERSONS

Affected persons: any person who has concluded a purchase contract with the Operator through the Operator's online E-shop.

VI. PERIOD OF PROCESSING OF PERSONAL DATA

Period of processing of personal data: for the period necessary for the exercise of rights and obligations arising from the contractual relationship between you and the Controller and the exercise of claims arising from these contractual relationships. After the expiry of the retention period, the Data Controller will delete the personal data

If we process data on the basis of your consent, the processing period is specified in the consent.

VII. RECIPIENTS OF YOUR PERSONAL DATA

Recipients of your personal data: the operator, persons involved in the delivery of goods under contract, persons providing services for the operation of the E-shop and other services in connection with the operation of the E-shop, persons providing marketing services for our company

VIII. FURTHER INFORMATION

We will not transfer that personal data to a third country or international organisation.

The provision of personal data by the customer is a contractual requirement if it is necessary for the performance of contractual obligations. The customer is not legally obliged to provide personal data, but the data is necessary for the conclusion and performance of the contract. Without this data, we would not be able to enter into a contract with you at all and to fulfil the obligations and rights arising from it. If the processing of personal data is based on consent, the customer has the right to withdraw his consent to the processing of personal data at any time.

IX. INFORMATION ABOUT YOUR RIGHTS

RIGHT TO INFORMATION: You have the right to receive clear, transparent and understandable information about how we use your personal data and what your rights are.

RIGHT OF ACCESS: You have the right to access your data. Upon your request, we will issue you with a confirmation as to whether personal data about you as the data subject is being processed. If we are processing this data, we will issue you with a copy of this personal data upon request.

If you request information by electronic means, it will be provided to you in a commonly used electronic format, in the form of an email, unless you request otherwise. We will process the request free of charge, except for a fee which may not exceed the amount of the reasonable out-of-pocket costs of making copies, procuring the technical media and sending the information to you, unless a specific law provides otherwise. We are obliged to deal with your request in writing within 30 days from the date of receipt of the request at the latest.

RIGHT TO CORRECTION: You have the right to have your personal data corrected if we have recorded incorrect personal data about you. You also have the right to have incomplete personal data completed. We will correct or complete the personal data without undue delay after you ask us to do so.

RIGHT TO DELETION: You have the right to erasure of personal data concerning you. You would not have this right if processing is necessary:

(a) to fulfil an obligation under a law, a special regulation or an international treaty by which the Slovak Republic is bound, or to fulfil a task carried out in the public interest or in the exercise of official authority vested in the controller,

(b) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, where the right to erasure is likely to render impossible or seriously impede the achievement of the purposes of such processing; or

(c) to prove, exercise or defend legal claims.

If you request the deletion of your personal data, we will carry out this deletion of your personal data on the basis of your request, without undue delay after receipt of the request, unless there is a legal reason for not deleting it.

RIGHT TO WITHDRAW CONSENT AT ANY TIME: Where you provide personal data on the basis of your consent, we cannot require you to consent. You are under no obligation to give us consent to process your Personal Data. If you have given us consent to process your personal data, you may withdraw your consent at any time.

You have the right to restrict the processing of personal data if:

(a) you contest the accuracy of the personal data during a period allowing the controller to verify the accuracy of the personal data;

(b) the processing is unlawful and you request a restriction on the use of the personal data instead of erasure;

(c) we no longer need the personal data for the purposes of the processing, but you need it to establish, exercise or defend legal claims;

If you request restriction of the processing of your personal data, we will not be able to carry out any processing operations, other than storage, on the data concerned without your consent. You will be informed by us if the restriction on the processing of this data is lifted.

RIGHT TO PORTABILITY: You have the right to data portability, which means obtaining the personal data that you have provided to us, and you have the right to request the transfer of that personal data to another controller.

RIGHT TO OBJECT: You have the right to object at any time to the processing of your personal data on grounds relating to a particular situation, including profiling. We may not further process personal data unless we can demonstrate compelling legitimate interests for the processing of personal data which override your rights or interests or grounds for exercising a legal claim. You may object to the processing of the personal data provided on the basis of a legitimate ground for the performance of a task carried out in the public interest or in the exercise of official authority, or on the basis of a legitimate interest of the controller. We may not further process personal data unless we can demonstrate compelling legitimate interests for the processing of personal data which override your rights or interests or grounds for exercising a legal claim.

As a data subject, you have the right to object to the processing of personal data concerning you for the purpose of direct marketing, including profiling to the extent that it is related to direct marketing. If you as a data subject object to the processing of personal data for the purpose of direct marketing, the controller may no longer process the personal data for the purpose of direct marketing. You can express your opposition to the processing of your personal data for the purpose of direct marketing by ticking the box via the online shop www.zingidrink.com.

RIGHT TO FILE A COMPLAINT WITH THE AUTHORITY: You have the right to file a complaint with the Office for Personal Data Protection of the Slovak Republic if you believe that your rights in the area of personal data protection have been violated.

X. COOKIES

The website of our online shop uses "cookies".

Cookies are files that allow the device used to browse the internet (e.g. computer, smartphone, etc.) to remember specific information relating to the device used.

The information stored in cookies is used, among other things, for advertising and statistical purposes and for the purpose of tailoring our website to your individual needs.

XI. FACEBOOK PLUGIN

Our website contains a plugin to the social network Facebook (Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA). The Facebook plugin on our website is marked with the Facebook logo. This plugin connects you directly to our Facebook profile. Facebook is then able to obtain the information that you have visited our page from your IP address. If you visit our site and are logged in on your Facebook profile, Facebook will record information about your visit. Even if you are not logged in, Facebook can obtain information about your IP address.

We would like to point out that Facebook does not provide us with information about the data collected and how it is used. The purpose and scope of the data collected by Facebook are unknown to us.
